Gaza rocket hits southern Israel



A rocket fired by Gaza militants on Sunday hit southern Israel in what was the fourth projectile lobbed across the border since a truce took hold two days earlier, Israeli officials said.

The rocket landed near Khatzerim, a village just west of the southern desert city of Beersheva, a police spokeswoman said.
An army spokeswoman said it was the fourth incidence of firing since the truce came into effect at 0330 IST on Friday morning.
"The rocket hit an empty area without causing injuries or damage," a she said.
The latest ceasefire was put in place after a week of spiralling violence in and around Gaza which left 26 Palestinian and an Israeli dead.
An earlier truce announced last Sunday lasted less than 48 hours.
The fighting erupted after a deadly series of shooting attacks on a desert road just north of the Red Sea resort town of Eilat that killed eight Israelis and which Israel blamed on the Gaza-based Popular Resistance Committees.

BJP finds considerable merit in Hazare's three demands:Arun Jaitley

Senior BJP leader Lal Krishna Advani expressed hope that the discussion in Lok Sabha will enable a strong Lokpal. He appealed to Anna Hazare to end his fast.

Leader of Opposition in Lok Sabha Sushma Swaraj said that BJP will vote in favour of all three issues raised by Hazare team if govt brings a resolution.She said history has given the House an opportunity to pass this legislation and it should not miss it by getting entangled in technicalities.

Participating in the debate, Congress leader Sandeep Dikshit said the debate should firstly limit its aim to reaching a consensus so that Hazare can end his fast.

Leader of Opposition in the Rajya Sabha Arun Jaitley said in the Upper House that BJP finds considerable merit in Hazare's three demands, including covering entire bureaucracy and Citizens' Charter for public grievances under Lokpal and setting up Lokayuktas in states.

On a question posed by Pranab Mukherjee that whether a central legislation can dictate state bureaucracy, Jaitley said that state legislatures can pass the bill as enabling legislation while the Lokpal bill serves as the model to it.

On other contentious aspects like bringing Prime Minister under purview of Lokpal, Jaitley favoured it with the exceptions of certain areas like national security.

On inclusion of higher judiciary under Lokpal, Jaitley said there was need for a National Judicial Commission, because judges should not appoint judges.Jaitely found "greater merit" in having a Citizens' Charter for redressal of grievances of the common man.

CPI-M leader Sitaram Yechury said he agreed 'in-principle' with the three issues raised by the team Anna but they will have to be implemented through constitutional procedures.

He said he wanted a new bill to be presented before Parliament which should be a "combination of best features of all the bills" including the Jan Lokpal Bill.

The Minister of State for Planning Ashwani Kumar voiced concerns in Rajya Sabha over demands like bringing the Prime Minister, conduct of MPs inside Parliament and lower bureaucracy under Lokpal's ambit.

Ashwani Kumar further said he was "distressed" by what was going on in Ramlila ground, where Anna Hazare is on fast for last 12 days demanding the passage of Jan Lokpal bill by Parliament.

Cautioning against provisions for appointment of Lokayuktas in states as suggested in Hazare's Jan Lokpal Bill, he said, "No attempts must be raised which could raise doubts about our intention, about the integrity of our federal structure."

He cautioned against rushing through the legislation "in haste or under pressure from people outside the House."

PM's Bangla visit to strengthen bilateral ties: Mamata

Prime Minister Manmohan Singh's forthcoming visit to Dhaka is aimed at strengthening Indo-Bangladesh ties, West Bengal CM Mamata Banerjee has said.

Banerjee, who would be accompanying the Prime Minister for the visit on 6th and 7th September said on Saturday, "We are going to Dhaka to strengthen ties between India and Bangladesh. We want to further improve relations between the two countries".

Uproar in Lok Sabha and the Rajya Sabha -on, Lokpal issue

Anna Hazare's fast on the issue of Lokpal cast its shadow on Parliament on Tuesday with both Lok Sabha and Rajya Sabha witnessing repeated adjournments over Lokpal Bill.The Lok Sabha and the Rajya Sabha were adjourned for the day without transacting any business after the two Houses witnessed two adjournments each.

It was trouble from the word go with BJP giving notices in both Houses for suspension of Question Hour to discuss the serious situation caused by lakhs of people in the country coming out on the streets to protest against corruption.

In the Lok Sabha, Leader of the Opposition Sushma Swaraj hit out at the government saying "it cannot wash its hands off the protests which are a result of the deep-rooted corruption in the government."

Swaraj dubbed the Lokpal Bill introduced by the government in the Lok Sabha as "poor, weak and ineffective".

The Lok Sabha also witnessed clashes between DMK and BJP members over issues to be taken up for discussion.

BJP members wanted an immediate discussion on corruption in the backdrop of Hazare's agitation, while the DMK pressed for a debate on Sri Lankan Tamils as listed in the agenda.

Both the Houses saw two adjournments - first soon after it met for the day and then at noon till 2 PM.

When the House met at 2 PM, the BJP and DMK members clashed again and Deputy Speaker Kariya Munda adjourned it for the day.

The story in the Rajya Sabha was no different. As soon as the House reassembled at 2 PM, BJP members rushed to the well and raised slogans, forcing the Chair to adjourn the House for the day.

BJP members led by Purshottam Rupala and Rudra Narayan Pany and AIADMK members raised slogans demanding a statement from Prime Minister Manmohan Singh on the Hazare issue.

In the Lok Sabha, as soon as the Speaker took up the first listed question, Opposition members were on their feet demanding suspension of Question Hour and discussion on corruption.

The Speaker said there was no rule that allows suspension of the Question Hour. However, as a special case she would allow leaders of parties to put forth their views on corruption and take up the Question Hour thereafter.

She then called Swaraj to speak. As Swaraj made references to several scams allegedly involving some Union ministers, Parliamentary Affairs Minister P K Bansal objected to it contending that the Leader of the Opposition was speaking on a matter which was beyond the ambit of the notice.

They have pitted Aruna Roy against Anna team.This lady is stooge of
Sonia Gandhi and member of NAC an Extra constitutional civil body.In
other words Sonia is trying to dominate this movement and get her
version passed.Obviously Aruna Roy is frustrated person yearning for
her own publicity.This is the reason Indians are being enslaved since
last 1000 years.

The government Lokpal is so corrupt bill that instead of punishing
corrupt babus and politicians it targets even unaided NGOs to arm
twist and blackmail them and also punish whistleblowers instead of
protecting them.Punishment to babu is minimum 6 months and to
complainant is 2 years.
In other words these corrupt MPs have come up openly with a bill to
crush anti corruption movement and support corruption through lokpal
act.Such open and naked arrogance and sinister plotting can be
possible in India only.It is time to pack bags of sonia and her
associates and show black flag to congress party.

Already 1.7 crore people have sent sms supporting Anna jan Lokpal Bill
and 7 lac people have signed petition in support of Anna on
Avaaz.org.What more proof of public opinion in needed.Parliament and
MPs are advised not to try to act above people of India.MPs are

World Championships: 10-member Indian boxing team announced

World Championships: 10-member Indian boxing team announced
A 10-member Indian boxing team was announced on Thursday for the World Championships in Azerbaijan next month. Rookie L Devendro Singh of Manipur was the surprise pick while established names such as Vijender Singh and Akhil Kumar expectedly fetched a berth in the team.

The members of the team are: L Devendro Singh (49kg), Suranjoy Singh (52kg), Akhil Kumar (56kg), Jai Bhagwan (60kg), Manoj Kumar (64kg), Vikas Krishan (69kg), Vijender Singh (75kg), Dinesh Kumar (81kg), Manpreet Singh (91kg), Paramjeet Samota (+91kg).

The World Championship is scheduled to be held in Azerbaijan capital Baku from September 22 to October 10. It is the first Olympic qualifying event from where all quaterfinalists will make the cut for the London Games.

The second and final Olympic Qualification Tournament for

Asia will be held in Kazakhstan in March 2012. The Indian team will be first proceeding for a training camp to France from September 10 to September 21 prior to their participation in the World Championships.

National coach Gurbax Singh Sandhu called it a strong team with the potential of not just securing Olympic berths but also winning medals at the event.

CBI conducts searches at premises of Jagan Reddy

A day after it registered an FIR against YSR Congress chief Y S Jagan Mohan Reddy in the illegal assets case, the CBI on Thursday conducted searches at the premises of various companies which have invested in the businesses of the Kadapa MP in five cities. The searches were carried out in Hyderabad and other places in Andhra Pradesh besides Bangalore, Chennai, Kolkata and Mumbai. The searches were being carried out at some of the offices of the firms owned by Jagan, besides at the residence of the Kadapa MP and that of his relatives in posh Banjara Hills area in Hyderabad. CBI searched the premises of AP Principal Secretary (Home) B P Acharya and also registered a case against Dubai-based Emaar properties and searched the premises of real estate developer Emaar-MGF in Hyderabad and Delhi. It is a case of conspiracy between AP government officials and Emaar in the development of villas and apartments, the agency said. The Andhra Pradesh High Court had on August 10 ordered a CBI inquiry into the land allotments made to Emaar by the then Rajasekhara Reddy Government and dilution of the stake of Andhra Pradesh Industrial Infrastructure Corporation (APIIC) in the joint venture with Emaar for the development of a township in the city.
Separate teams were formed to conduct the searches after the central agency approached the CBI Special Court to seek search warrants for over 90 locations owned by as many as 32 corporates and some individuals who have invested in the firms owned by Jagan.
Acting on the separate petitions filed by Textile Minister P Shankar Rao and TDP leader Yerran Naidu, the Andhra Pradesh High Court had recently ordered CBI to probe the alleged illegal assets that the Kadapa MP had amassed during his father's regime as Chief Minister.The agency in a separate case searched the premises of Principal Secretary (Home) Acharya and builder Emaar-MGF in Hyderabad and Delhi.The case relates to alleged criminal conspiracy between state government official and Dubai-based Emmar group for diluting state government's Andhra Pradesh Industrial Corporation's stake in a posh township developed through a joint venture, the agency spokesperson said.Reacting to the development, Executive President Emmar-MGF Sanjiv Saddy said, "As a corporate policy, the group always cooperates with the investigating agency and adheres by the law. We are providing all the documents sought by the CBI officials and cooperating with them."The Andhra Pradesh High Court had on 10th August ordered a CBI inquiry into the land allotments made to Emaar by the then Rajasekhara Reddy Government and dilution of the stake of Andhra Pradesh Industrial Infrastructure Corporation (APIIC) in the joint venture with Emaar for the development of a township in the city.
CBI, which constituted 15 teams for the operation, searched some of the offices of the firms owned by Jagan, besides his residence and that of his relatives in posh Banjara and Jubilee Hills area in Hyderabad.Searches were on at the residences of Vijay Sai Reddy, who is vice-president of Jagati Publications (which publishes Sakshi Telugu newspaper and also Sakshi TV), owned by Jagan, and his sister Sharmilas residence at Sagar Society in Hyderabad.The CBI teams also conducted searches at the residences and office premises of individual investors including Nimmagadda Prasad of Matrix Labs and Lagadapati Sridhar who runs Jubilee Media in Hyderabad. Sridhar is youngest brother of Vijayawada MP Lagadapati Rajagopal.

Among the firms where CBI conducted searches include R R Global, Sandur Power, Jagati Publications, Carmel Asia Holdings and Bharati Cement.
CBI Joint Director V V Lakshmi Narayana, who is heading investigations, said they would brief the media on the developments after completion of the searches.
A senior CBI officer said, "Searches were conducted at the residence of Acharya and we have collected some documents".
Acharya was the then managing director of Andhra Pradesh Industrial Infrastructure Corporation (APIIC).
The controversy centres around dilution of APIIC's equity from 49 percent as agreed in the original memorandum of understanding (MoU) to 26 percent and also Emaar roping in its group company Emaar-MGF Land Limited as a co-developer for the township component of the 258-acre integrated township project at Gachchibowli in Hyderabad.

Thiis covenant concluded when Team Anna, meeting ,Kiran Bedi, Prashant Bhushan, Manish Sisodia and Arvind Kejriwal had with Delhi Police commissioner B K Gupta at the latter's residence in Chanakyapuri shortly after midnight. KiranBedi said the police commissioner offered permission for 14 days of protest by 73-year-old Hazare at the Ramlila Ground, after which she, along with Bhushan, Sisodia and Kejriwal went back to the Tihar Jail, to apprise him of the offer.

 Bedi said on the micro-blogging site that Delhi Police "removed the unacceptable conditions and offered 15 days permission. Anna accepted there".

"Anna has accepted the DP permission for two weeks. Anna now shall be at Ramlila grd post 3PM", she added.

When the Lok Sabha met for the day, Speaker Meira Kumar informed the House that suspension of Question Hour notices had been given by Leader of the Opposition Sushma Swaraj, CPI leader Gurudas Dasgupta and JD(U) member Sharad Yadav among others.They wanted an immediate debate on the detention of Hazare and on the larger issue of corruption.The Speaker disallowed the notices for adjournment motion given by Yogi Adityanath (BJP) and Shailendra Kumar (SP) on Hazare and some issues related to Uttar Pradesh.

She said there was no provision for suspension of Question Hour in Lok Sabha, but asked the members making this demand to "briefly touch upon the subject".
However, when Swaraj rose to speak, Parliamentary Affairs Minister P K Bansal intervened and said, "My submission is that the government is prepared for a discussion at 12 (noon). They make their point and then the House is disrupted..."
He insisted that if Swaraj is allowed to speak, the Home Minister should also be allowed to make a statement.Agitated members of BJP, JD(U), CPI-M, CPI, SP and BSP were on their feet objecting to Bansal's comments.
Congress members too were on the feet and demanded that the Question Hour be held.
Sanjay Nirupam (Cong) said his party was objecting to opposition parties supporting those going against democracy.The Speaker then adjourned the House till 11:30 am.When the House re-assembled, similar scenes were witnessed and the Chair adjourned it till noon.There was uproar again at noon, with BJP members chanting that the government was "murderer of democracy" and insisted that Swaraj be allowed to speak.Sinha said there was "undeclared emergency" and declared the House will not be allowed to function till Swaraj spoke.Swaraj was unhappy for being disallowed to speak even though Bansal had promised that she could do so at noon.


The Speaker, while disallowing it, said it was a matter related to the Question Hour.The BJP members rushed to the well creating pandemonium, prompting the Chair to adjourn the House for the day.Swaraj alleged that Bansal was defying the Speaker by not allowing her to speak.
"The undemocratic attitude adopted by the government outside the House is being adopted inside as well," she said.In the din, a short duration discussion on Sri Lanka could not take place even as the Speaker called DMK leader T R Baalu to initiate it.In the Rajya Sabha, when Chairman Hamid Ansari took up the first question, Jaitley rose to make a statement.Ruling Congress members prevented Jaitley from speaking.

"Let us hear the Leader of the Opposition," Ansari said as Congress members stood up demanding that the Question Hour be taken up first.At this, opposition members shouted back at the ruling benches, plunging the House into turmoil.Minister of State for Parliamentary Affairs Rajeev Shukla said the Home Minister will make a statement at noon.But this failed to pacify the opposition members and the din grew louder with ruling party members raising their pitch against Jaitley being allowed to speak."This is not right.     PM announces setting up of Education a commission


    Keen on enhancing the quality of edu in the country, PM Manmohan Singh announced the govt's decision to appoint a commission to make recommendations in this regard and talked about moves to universalise secondary education.

    Addressing the nation from the ramparts of the majestic Red Fort on the 65th Independence Day on Monday, Singh said vocational education and skill development have acquired new importance and considering the "major changes", the government has decided to appoint the commission.
    "In view of these major changes, it is necessary that we consider all aspects of education in a comprehensive manner. Therefore, we have decided to appoint an education commission to make recommendations for improvements at all levels of education," he said.
    Expressing satisfaction over achievements in the education sector, Singh said government was considering universalisation of secondary education as it did in case of elementary education through the Right to Education Act.
    As per RTE, education is free and compulsory upto eighth standard and universalisation of secondary education will make it free and compulsory upto Class X.
    "Today every citizen has a right to elementary education. We are now considering universalisation of secondary education.
    "We are satisfied with our achievements in the last seven years in the areas of education and health.Whether it is elementary education, secondary education or higher education we have taken concrete steps for improvements at all levels," he said.
    Noting that government had emphasised on education in the 11th Five Year Plan, Singh said similar priority will be given to the health sector in the 12th Five Year Plan.
    "I have often referred to the 11th Five Year Plan as an education plan. We will lay the same emphasis on health in the 12th plan as we laid on education in the 11th plan," he said.
    Singh said he will propose to the National Development Council that the 12th plan should be specially focused on health.
    "I also promise that funds will not be a constraint in the important areas of education and health," he said.
    Holding that health insurance for workers in the unorganised sector was a priority; he said government will endeavor to cover as many workers as possible under the Rashtriya Swasthya Bima Yojana which was introduced in 2008.
    "In the last year we have covered those getting employment under Mahatma Gandhi Rural Employment Act and also domestic workers, street vendors and beedi workers under this scheme," he said.
    He said about 2.5 crore workers have already been covered under the scheme.
    "Our government will endeavour to cover as many unorganized sector workers as possible under this scheme."

    Hasan Ali Khan gets bail
    The Bombay High Court on Friday granted bail to Pune stud farm owner Hasan Ali Khan, arrested in March for alleged involvement in multi-crore money laundering scam, observing that there is nothing in Enforcement Directorate's case to show that the money amassed by him are proceeds of crime.

    "There are no ingredients of proceeds of crime in the case made out by the Enforcement Directorate against Hasan. He deserves to be released on bail," Justice A M Thipsay observed while granting bail to 53-year-old Khan on a surety of Rs five lakh.
    Khan was arrested by ED and booked under the provisions of Prevention of Money Laundering Act (PMLA). The court, however, directed him to appear before ED everyday and stay either in Mumbai or Pune. 

    Additional Solicitor General Darius Khambata, appearing for ED, requested the court to stay the bail order for a week to enable the agency to appeal against the judgement in the Supreme Court.Justice Thipsay, however, turned down the plea saying, "There is no apprehension that he (Hasan) would abscond or tamper with evidence. Hence there is no necessity to stay the bail order."
    The court had earlier said that ED should find out if the money allegedly amassed by Khan are proceeds of crime. "There cannot be a presumption on this," the court had said. Khan's lawyer I A Bagaria had argued that he had been falsely implicated in the case. He had contended that Khan had no links with international arms dealer Adnan Kashoggi and had no accounts in foreign banks.

    Khadi and Village Industry Products To improve the sale of khadi and village industry products the Ministry of Micro, Small and Medium Enterprises through KVIC has taken steps which include introduction of a scheme named ‘Strengthening Infrastructure of Existing Weak Khadi Institutions and Assistance for Marketing Infrastructure’ which inter alia, provides for renovation of khadi sales outlets owned by institutions, KVIC or State/UT Khadi and Village Industries Boards; implementing a project based scheme named “Product Development, Design Intervention and Packaging(PRODIP)” to improve the marketability of khadi and village industries products through improvement in quality, design and packaging and implementing a comprehensive ‘Khadi Reforms and Development Programme’ with assistance to the tune of US $ 150 million from Asian Development Bank (ADB) in 300 selected khadi institutions over a period of three years from 2009-10, which provides for opening of new sales outlets in metropolitan cities and state capitals and renovation and modernization of institutional sales outlets, besides setting up of a Marketing Organization under Public Private Partnership with professional support.

    This information was given by the Union Cabinet Minister for Micro, Small and Medium Enterprises, Shri Virbhadra Singh in a written reply to a question in the Lok Sabha today.

    Uranium Reserves in Country
    The Atomoic Minerals Directorate for Exploration and Research (AMD) has established the presence of 1,71,672 tonnes of Uranium (U3O8) as on last month of June. This is a constituent unit of the Department of Atomic Energy Commission. The indigenous Uranium resources are adequate to fuel reactors of the capacity of about 10,000MWe.

    At present AMD is exploring uranium deposits at Tumallapalle-Rachkuntapalle,Kadapa district in Andhra Pradesh, Rohil, Sikar district in Rajasthan, Wahkut and Umthungkut in Meghalaya, Gogi, Gulburga district in Karnataka, , Sinridungari –Banadungri and Bangurdih, Singhbhum district in Jharkhand.Out of these deposits,63,269 tonnes of uranium (U3O8) have been established during the XI Plan Period. In Rohil, the Exploratory Drilling done till date has established 5,100 tonnes of uranium (U3O8).In About 19,738 tonnes .4,682 tonnes and 50,987 tonnes of of uranium(U3O8) has been established in Meghalaya , Gogi and Jharkhand respectively. There are number of smaller deposits in Chhattisgarh, UP and Katnataka.

    Leader of the Opposition in the Lok Sabha Sushma Swaraj said, "We seek the ouster of Delhi Chief Minister Sheila Dikshit. We will not allow Parliament to function. She should go."

    The CAG, in its report, has indicted Delhi chief minister for the Commonwealth Games Scam.Delhi CM Sheila Dikshit was in the eye of a storm in Parliament on Monday with an agitated Opposition paralysing both the Houses demanding her immediate resignation over alleged irregularities in CWG projects.It was trouble from the word go, with the NDA seeking suspension of Question Hour and the Left parties giving notices for Adjournment Motion in the Lok Sabha on the CAG observations on the CWG issue.
    BJP leader Yashwant Sinha said, "We are seeking the suspension of Question Hour in the Lok Sabha. We want a debate in the House on Maken's statement made on the Commonwealth Games. We will also seek a discussion on the CAG report on CWG, in which Sheila Dikshit has been indicted."Opposition NDA members stormed the well leading to the adjournment of both Lok Sabha and Rajya Sabha till noon.When the two Houses met again, it was a similar story and the presiding officers adjourned the proceedings till Tuesday.

    In the Lok Sabha, Samajwadi Party members demanded dismissal of the Mayawati government in the wake of reports that Uttar Pradesh has the highest incidence of fake encounters. They trooped into the well, shouting slogans and waving copies of news reports.Deputy Speaker Kariya Munda, who was in the chair, asked ministers to lay the papers listed for the day and allowed introduction of two bills.
    As the din continued, he adjourned the proceedings for the day.In the Rajya Sabha too, BJP members trooped into the well shouting slogans demanding Dikhsit's resignation.They were supported by members of Shiv Sena, JD(U), AIADMK and the Left parties, who were on their feet.

    Amidst of sloganeering, Deputy Chairman K Rahman Khan allowed papers to be laid and adjourned the House for the day.Earlier, as Speaker Meira Kumar took up the Question Hour, NDA members began shouting slogans against the Delhi government and demanded Dikshit's resignation contending that the CAG had indicted her in the CWG issue.

    Kumar continued with the Question Hour as members of the BJP, Shiv Sena and SP raised slogans in the well. BSP members were seen shouting slogans and countering the SP members.

    The Speaker told BJP member Varun Gandhi to ask a supplementary. As Gandhi stood up to ask his question, BJP member Bijoya Chakraborty signalled him against doing so.

    Planning Commission Deputy Chairman Montek Singh Ahluwalia says, the Prime Minister's Office (PMO) cannot be held responsible for the irregularities in the 2G spectrum allocation.

    Speaking at a TV programme, he said, he does not think that the Prime Minister should be behaving as the Super Minister, supervising everything that his colleague does. He said this in response to a question on whether former Telecom Minister A Raja followed the Prime Minister's advice to be cautious and transparent while giving licences and 2G spectrum in 2007-2008.

    Mr. Ahluwalia clarified that the PM had been assured that policies were being followed and deviations, if any, had the approval of the Solicitor General. He said, in an environment like that if something wrong or unfair is being done by a Ministry, people affected take the matter to court.

    If the PM keeps monitoring, then Mr. Ahluwalia said, we are not running a Cabinet government, we are running something like a micro-managed form of government. He was of the view that various ministries were responsible for carrying out the affairs of the government and the Prime Minister alone cannot be held responsible for everything.

    India Violates UN Convention against Corruption after Ratification, Demonstration in Front of United Nations on August 12

    New York, NY - The government of India has prepared an Ombudsman Bill (Lokpal Bill) that has greater penalties for a complainant who is unable to prove his complaint against a public servant than the public servant who has been proven to be corrupt. In letter and spirit, the bill is designed to give greater protection to the corrupt and leave out from its purview more than 98% of the public servants in the country. This violates the UN Convention against Corruption (UNCAC) that India had ratified in May of this year and was among the last fifteen countries to ratify. Condemning this act of irresponsible governance by the Indian Government, people concerned by this development are staging a peaceful protest at Dag Hammarskjold Plaza Park, across United Nations, New York, NY from 11 am to 1 pm on Friday, August 12, 2011.

    Billions of dollars of public funds that could have completely eradicated poverty and infrastructure problems in India are regularly stolen and lost every year due to corrupt government administrators and politicians who thrive in a system that has ineffective anti-corruption institutions and laws.

    In the preamble to the convention, the UN notes “...illicit acquisition of personal wealth can be particularly damaging to democratic institutions, national economies and the rule of the law..”. India has been struggling with this problem for decades. UN also notes that “... with the support and involvement of individuals and groups outside the public sector, such as civil society, non-governmental organizations and community-based organizations, if there their efforts in this area are to be effective”. However, the Indian government is doing its best to minimize and even avoid the participation of people and organizations outside the government in passing and formation of the anticorruption laws.


    The Lokpal Bill has been pending since 1969 and though revived on several occasions, never got enacted as law by the Indian government. After signing the UNCAC treaty the Government of India once again decided to revise the Lokpal Bill. But the question remains, “Does Lokpal Bill incorporate the national legislative requirements to enforce the norms of the UN convention against corruption”?


    Below are some samples of violations between UNCAC norms and the proposed bill.


    Article 2(a)(i)- UNCAC defines “Public official” as any person holding a legislative, executive, administrative or judicial office of a State Party, whether appointed or elected, whether permanent or temporary, whether paid or unpaid, irrespective of that person’s seniority. Hence can be subjected to investigation under corruption charges

    But Government’s Lokpal bill excludes the Prime Minister, Judiciary, all government employees below a high rank, and all state and local government employees, leading to exclusion of more than 98% of all the public employees in the country.



    Article 5(1) – “It is necessary to have coordinated anti-corruption policies that promote the participation of society and reflect the principles of the rule of law“. Article 33 – Titled as “Protection of reporting person”.

    Whereas the Lokpal bill does not mention anything about whistleblower’s protection, rather will award a minimum of 2 years jail term if the complainant is unable to prove his charges of corruption against the accused public servant. This clause will strongly discourage public from reporting the wrongdoings.


    Article 6(2) -– “Grant the body or bodies... the necessary independence, in accordance with the fundamental principles of its legal system, to enable the body or bodies to carry out its or their functions effectively and free from any undue influence”.

    The Lokpal bill states that the Lokpal will contain four out of nine members who are not of Judicial background, however the nine members are elected by five politicians, one independent member and only three people of judicial background. Thereby if the selection of the members to the Lokpal is controlled by politicians, the efficiency of such a panel becomes questionable.


    Article 13 (1) (a) – “Enhancing the transparency of and promoting the contribution of the public to decision-making processes”.

    Most of the damage occurs due to the manipulations at the decision making level. There is no provision in the Lokpal Bill for making decision process more transparent.


    Article 35 – “ entities or persons who have suffered damage as a result of an act of corruption have the right to initiate legal proceedings against those responsible for that damage in order to obtain compensation.”

    There are no clear norms in the Lokpal bill regarding the compensation for the damage. Only the public exchequer can claim for the loss from the offender, but not the victim.


    Article 8 (2) – provides that “in particular, each state party shall endeavor to apply within its own institutional and legal systems, codes or standards of conduct for the correct, honorable and proper performance of public functions”

    Government bill has no provisions to force govt. departments to do their public functions (citizen’s charter that is formulated by the respective government departments).


    Above mentioned violations are only a small sample and the entire bill contains several clauses to protect the corrupt rather than punish. With the Lokpal bill proposed by the government not following the most important aspects of the convention, we as concerned citizens of the world’s largest democracy are executing our duty to voice against this move of the Indian Government and seek intervention from the United Nations Office on Drug and Crime.

If it does not work, then the price of gas for Ukraine will exceed $ 450 per one thousand cubic meters. Meanwhile, prosecutors once again demand imprisonment of ex-premier Yulia Tymoshenko. Such a request was voiced by prosecutor Lilia Frolova, arguing that the defendant and her behavior make it impossible to ensure compliance with procedural rulesUkraine's former Prime Minister Yulia Tymoshenko, on trial over the 2009 gas deal with Russia, demanded during a court session on Friday that testimony given by the country's current premier, Mykola Azarov, in Russian be translated into Ukrainian.
    "I understood nothing from what Azarov said, not even a word," Tymoshenko, a native speaker of Russian, told the court. "I don't understand Russian."

    Tymoshenko, currently Ukraine's opposition leader, is being prosecuted for signing a 2009 gas contract with Russian gas company Gazprom which Kiev says is disadvantageous to Ukraine and which, according to the new government that came to power last year, Tymoshenko had no right to sign.

    Friday's court hearing was delayed for half an hour because Tymoshenko was late to appear in the courtroom. During the hearing, state prosecutor Lilia Frolova asked the court once again to arrest Tymoshenko rather than just maintain its current ban on her traveling outside Kiev after the defendant accused Azarov of corruption while he was giving his testimony.In late July, the court rejected a previous request by the prosecutor to arrest Tymoshenko, who is accused of constantly disrupting order in the court room and deliberately procrastinating.

    The judge again rejected on Friday a request by Tymoshenko's new lawyer, Yuriy Sukhov, to delay the trial to provide him additional time to study case materials, which occupy thousands of pages. Sukhov became Tymoshenko's lawyer on Monday after her previous lawyer was removed from the case by the presiding judge for contempt of court because he continually refused to stand when the judge entered the courtroom.The court also rejected Tymoshenko's request to have the judge removed.

    Friday's session took place amid demonstrations on Kiev's central Khreshchatyk Avenue staged by supporters and opponents of the former prime minister.

    Besides the gas case, the ex-premier also faces charges of misusing $425 million that her government received in 2009 from the selling its carbon emission rights under the Kyoto protocol. She faces up to ten years behind bars if found guilty.

    Tymoshenko has repeatedly dismissed all charges brought against her as political, saying she is being targeted for opposing President Viktor Yanukovych, who narrowly beat her in the presidential election in February 2010.

    Syrian Prez endorses general election

    Syrian President Bashar al-Assad on Thursday endorsed the multi-party and general election laws, as part of reforms announced by him of late to meet the Syrian people 's demands.


    The multi-party law would allow other parties to compete with the ruling Baath party in any coming elections, while the election law would regulate the parliamentary and local council elections and ensure the safety of electoral process and the right of candidates to supervise the process.

    The move comes at a time when the Syrian leadership is facing escalating international outcry over its alleged crackdown on protestors.

    CAG blames Sheila, Lt. Governor

    CAG report points the finger at Sheila Dikshit and LG Tejinder Khanna for the CWG mess two has been indicted by the Comptroller and Auditor General (CAG) for causing loss to the exchequer in awarding contract.Barapulla Nalla flyover, street lighting and street-scaping for street-lighting to a disqualified firm,Shiela accused of irregularities in purchase of potted plants and ‘avoidable’ cost escalation in street-scaping.This CAG disclosure to ignite uproar in Parliament and give an opportunity to Opposition to target the UPA Government over corruption.

    The report on the CWG, CAG found that the contracting firm M/s Space Age Switchgear, rejected disqualified by the PWD,re-inducted in the vendors list for street-lighting at the instructions of the Delhi Chief Minister.

    The CAG report, which has been submitted to President Pratibha Patil, indicts Dikshit for her role in roping in the vendor, which provided the equipment at an exorbitant margin of 500 per cent.

    E channel CNN-IBN, CAG report states that M/s Space Age Switchgear imported lights from Saudi Arabia at a per unit cost of `5,040 and supplied it to the Delhi Government for `25,704 per unit. Space Age Switchgear,earned a exorbitant profit to tune of `2.5 crore.CAG further disclosed that that the same company supplied the lighting equipment to different departments of the Delhi Government and the MCD at different rates.

    Chief Minister intend the exorbitant expenses incurred on street-scaping during the CWG, CAG came to this conclusion after comparing the cost with expenses incurred by the NHAI and Indian Railways for the same purpose.Chief Minister’s woes, the CAG disclosed gross violations on the part of Dikshit in ordering purchase of 60 lakh potted plants at more than 20 per cent of the market value.

    CAG too blamed the PWD for trying to mislead the auditors during the inspection. During auditing PWD told the CAG that several of the plants perished and the remaining plants were given to Government office. Criticizing the Delhi Government's attitude, CAG said that their inspection found that the claim was wrong.CAG finding is in line with the report of the Shunglu Committee on CWG. The Shunglu Committee had held Dikshit responsible for the delay that affected the execution of infrastructure projects and led to last-minute hiring of companies at huge costs. The committee had also referred to the alleged intervention by the Chief Minister to allow Space Age to supply street lights.
