2G scam : CBI submits status report on Maran in SC

The agency also said investigation against Essar Group was still on and it will take another two weeks to complete it.
CBI, which filed a fresh status report in a sealed cover about the progress of the investigation, said the preliminary inquiry on the alleged involvement of Maran in 2G scam has been completed and letters rogatory (LR) have been dispatched to Mauritius.
"The preliminary inquiry with regard to Maran has been concluded and FIR has to be registered against everyone. A few more days needed for the FIR and can be lodged by month-end," senior advocate K K Venugopal, appearing for CBI, told a bench of justices G S Singhvi and A K Ganguly.
Venugopal said there was delay in filing the third charge sheet in the case as the investigation was still on against Maran and Essar Group for allegedly creating a front company, Loop Telecom, for "illegally" securing the licence for 2G spectrum.
Essar Group has denied allegations of wrongdoing in the scam contending Loop Telecom was not its front company and even had got a clean chit from the Ministry of Corporate Affairs.
Venugopal, who read the portion of the status report about the probe on Maran's role, said CBI has written a letter to a particular company abroad and the follow-up will take place:
CBI on Wednesday submitted its status report on Dayanidhi Maran's alleged role in the 2G spectrum scam in the Supreme Court. According to the CBI sources, the agency told the Supreme Court that the probe against Essar-Loop company and DMK leader Dayanidhi Maran in the 2G case, is still on. An FIR against Maran would be filed by the end of this month
The JPC examining the 2G scam on Tuesday took exception to Finance Ministry's "attempts to supress facts" by not submitting to it the controversial internal note on the issue and decided to summon Finance Secretary R S Gujral for an explanation.

Blackmoney SC bench differs on Centre's plea on SIT

A two-judge bench of the Supreme Court on Friday gave a split verdict on the maintainability of government's application seeking recall of the apex court order on constitution of an SIT to probe blackmoney cases.
The order was passed by a bench comprising justices Altamas Kabir and S S Nijjar on the Centre's plea for recall of the court's 4th July decision.

While justice Kabir pronounced his verdict in favour of the government, saying the Centre's plea was maintainable, Justice Nijjar refused to hear the application, saying it is not maintainable.

In view of the split verdict, the bench referred the matter to the Chief Justice for constitution of a larger bench to decide the maintainability of the Centre's plea.

The apex court had on 4th July recast the high-level committee, formed by the Centre earlier to track blackmoney stashed away abroad, by setting up a Special Investigation Team and making ex-apex court judges B P Jeevan Reddy and M B Shah as its chairman and vice-chairman respectively.

The others in the 13-member SIT are directors of CBI, Intelligence Bureau, Enforcement Directorate, Chairman of CBDT, Director General of Revenue Intelligence, Director General of Narcotics Control, Director of Foreign Intelligence Office (FIO) and Joint Secretary of Foreign Trade, besides the Research and Analysis Wing (RAW) Director.

The apex court had recast the Centre's high-level committee expressing dissatisfaction over the pace of its functioning and saying the money stashed away reveal a degree of "softness of the State".

The Centre subsequently moved the apex court, seeking recall of its order.

But the apex court, before going into the merits of the Centre's application, had agreed to adjudicate whether it is maintainable as senior advocate Ram Jethmalani and others questioned its maintainability.

The Centre had in its recall application contended that the SIT was formed without being prayed for.

It has also questioned the Court's remarks that probe into the issue of black money stashed abroad was moving at a "laggardly pace".

During an earlier hearing, the Centre had also told the bench that the SIT set up by the apex court to probe and unearth black money needs to be scrapped as the investigating agency cannot function like a "super power."

Government to bring back stranded Burmese fishermen

Government to bring back stranded Burmese fishermen

Thursday, 15 September 2011

New Delhi (Mizzima) – The Myanmar Fisheries Federation says the Burmese government has negotiated with the Indian government to bring back 135 Burmese fishermen who were adrift at sea and have been stranded in Port Blair in Andaman Island.

“Originally, the authorities planned to send them back to Burma via an Indian coast guard ship. But the plan was delayed, so Burmese authorities are negotiating to bring them back to Burma via airplane,” said Win Kyaing, the general-secretary of the fisheries federation.

He said that the exact date had not been set.

About five months after the Indian government informed Burmese authorities that the marine workers had been rescued by its navy following a storm, officials began plans to bring them back. Most of the fishermen are from Pyapon township.

Most of the workers were adrift on their tiger-shaped rafts after a sudden storm in the Gulf of Martaban in March 2011. A few others were stranded earlier in the year. The fisheries federation said that more than 480 fishermen are still missing.

“We have had no clues for a long time, so I think they will be placed on the list of the deceased,” a fisheries official said.

Because of the March storm, 3,600 rafts from Twante, Kawhmu and Kungyangon townships in Rangoon Region and Labutta, Pyapon, Dedaye and Bogalay townships in Irrawaddy Region were damaged. An estimated 16,268 fishermen were adrift at sea, according to the federation.

“The Ministry of Livestock and Fisheries gave the lists of the names of the fishermen [who are missing] to the relevant ministries of the countries located along the coast of the Indian Ocean,” said Win Kyaing.

Justice issues of Kandhamal, Dalit Christian-at meeting of National Integration Council

Justice issues of Kandhamal, Dalit Christian demands raised at meeting of National Integration Council">[The following is an abridged version of the points raised by Dr John Dayal, Secretary General, All India Christian Council, at the meeting of the National Integration Council at Vigyan Bhawan, New Delhi on Saturday, 10 September 2011. The Prime Minister of India, Dr Manmohan Singh, chaired the meeting moderated by Union Home Minister Mr. P Chidambaram. Mr. L K Advani, BJP leaders Sushma Swaraj and Arun Jaitely, Defence minister A K Anthony, chief ministers of Orissa and other States, leaders of the Congress and other parties, leading industrialists were among the Members of the NIC present.Mr. Prime Minister, Honourable Union Ministers, Honourable Chief Ministers, distinguished Membersfor the speedy recovery of the injured. Above all, we pray eternal peace and prosperity for India, our motherland. We ourselves are victims of a different sort of socio-political terror, the terror of communalism. Our data shows we are targetted across the country with at least one incident a day of hate-motivated violence at some town or village, in one state or the other. Some states are worse than others. Among the worst are Karnataka and Madhya Pradesh, and districts such as Udaipur in Rajasthan. In many states, the local police and administration are  complicit. Often their actions and impunity blatantly encourage local violent elements. In Karnataka and Madhya Pradesh for instance, local police and administrative coercion and threatening of prayer services in homes, or house churches as they are called, almost immediately leads to acts of physical violence. Not every church has to be a large Cathedral. Jesus said “Wherever two or three are gathered in my name, I will be  there”. That is the basis of house churches, small Christian communities and Basic Christian Communities as they are called in the Evangelical, Episcopal  and Catholic denominations respectively.
Such targetting, intolerance and officially conducted  so-called “surveys” and demands for “registration” of churches must end forthwith. It does not happen with believers of other faiths, and it must Not happen with Christians.
Hate campaigns must also end. We have identified, as I am sure the governmetns' intelligence agencies must also have identified, the origin of such hate from  the headquarters of certain political groups who want India to be rid of its religious minorities, or wants them to live as second rate citizens. We are first class citizens, much  as everyone else, and seek our rights, the first of which is security so that we can enjoy that other right – freedom of faith and worship. Government must take urgent steps to train its police and administrative  personnel in the principles of secularism, and sensitize them on the needs of all minorities, and the Christian minority in particular.
The Targetted and Communal violence [prevention, reparation and justice] Bill  2011 drafted by the National Advisory Council seeks to ensure this. We still feel the Bill needs some fine-tuning on issues of protecting India’s federalism and the autonomy of States.. We also specifically seek Christian representation in the structures it envisages. We commend its early adoption by government and its enactment as law after checking the Constitutionality of every clause and sub clause.
It may come as a surprise to some, but our community also has its share and more of the poor and the deprived. The Dalit Christians are one such group. They must be restored their constitutional rights at the earliest as recommended by the Justice Rangnath Misra Commission. Other poor, specially among the tribals and the rural landless and fishermen,  must be identified and receive the assistance of the Government’s many schemes. For this it is important they first be identified. We have repeatedly demanded a Prime Minister’s Committee, on the pattern of the Justice Sachchar Committee set up for the Muslims,  to look into the socio economic and developmental status of the Christian community across the country. Such a  survey will help the Church generate its own development strategies. And it will help the government implement its secular agenda of development.
There must also not be any confrontation and conflict between the educational rights guarantees for minorities in the Constitution, and the new Right to Education Act. Across the country, our educational sector is facing harassment in recent months with local authorities trying to intimidate school managements.
In the drafting of the 12th plan, we have suggested several measures for the uplift of those of my brothers and sisters who are deprived, in education, hostel facilities, employment and self employment. I commend those recommendations made to the Ministry of Minority Affairs and the Planning Commission. They must form part of government policy and must be implemented.
I close with reflecting on the many lapses that have taken place in ensuring justice, rehabilitation and reparation to the Christians of Kandhamal district in Orissa.  Kandhamal saw an anti Christian pogrom in August, September and October 2008 and it seemed that the Connotation of India was not operative in that distant plateau in the centre of Odisha. Over 56,000 people were rendered homeless, over 5,600 housed destroyed, almost 300 churches torched, nuns raped. There was other and significant gender violence. According to our count, and the government differs, more than 90 persons lost their lives. Men and women lost livelihood and homes, jobs and fields. Children lost opportunities of education. Many villages banned the entry of Christians if they did not convert to Hinduism. Three years on, justice in the real terms remains a dream despite two Fast Track Courts which are known for witnessing the terrorizing of witnesses. Government aid for reconstruction was timid and small. The church helped out. But even then more than 2,000 houses remain unbuilt. It is shocking but many people have not been able to return home. Education, jobs, agriculture opportunities are missing. Even in the cases of murder, there has been no punishment in over 20 cases because the witnesses were scared or paid off. Sometimes  their terrorizing took place in court, as I have witnessed personally.
Justice must be done, Dear Prime Minister and Dear Chief minister of Odisha. We look to you for justice.I thank you for this opportunity to address the National Integration Council.”

Gaza rocket hits southern Israel

A rocket fired by Gaza militants on Sunday hit southern Israel in what was the fourth projectile lobbed across the border since a truce took hold two days earlier, Israeli officials said.

The rocket landed near Khatzerim, a village just west of the southern desert city of Beersheva, a police spokeswoman said.
An army spokeswoman said it was the fourth incidence of firing since the truce came into effect at 0330 IST on Friday morning.
"The rocket hit an empty area without causing injuries or damage," a she said.
The latest ceasefire was put in place after a week of spiralling violence in and around Gaza which left 26 Palestinian and an Israeli dead.
An earlier truce announced last Sunday lasted less than 48 hours.
The fighting erupted after a deadly series of shooting attacks on a desert road just north of the Red Sea resort town of Eilat that killed eight Israelis and which Israel blamed on the Gaza-based Popular Resistance Committees.

BJP finds considerable merit in Hazare's three demands:Arun Jaitley

Senior BJP leader Lal Krishna Advani expressed hope that the discussion in Lok Sabha will enable a strong Lokpal. He appealed to Anna Hazare to end his fast.

Leader of Opposition in Lok Sabha Sushma Swaraj said that BJP will vote in favour of all three issues raised by Hazare team if govt brings a resolution. She said history has given the House an opportunity to pass this legislation and it should not miss it by getting entangled in technicalities.

Participating in the debate, Congress leader Sandeep Dikshit said the debate should firstly limit its aim to reaching a consensus so that Hazare can end his fast.

Leader of Opposition in the Rajya Sabha Arun Jaitley said in the Upper House that BJP finds considerable merit in Hazare's three demands, including covering entire bureaucracy and Citizens' Charter for public grievances under Lokpal and setting up Lokayuktas in states.

On a question posed by Pranab Mukherjee that whether a central legislation can dictate state bureaucracy, Jaitley said that state legislatures can pass the bill as enabling legislation while the Lokpal bill serves as the model to it.

On other contentious aspects like bringing Prime Minister under purview of Lokpal, Jaitley favoured it with the exceptions of certain areas like national security.

On inclusion of higher judiciary under Lokpal, Jaitley said there was need for a National Judicial Commission, because judges should not appoint judges.Jaitely found "greater merit" in having a Citizens' Charter for redressal of grievances of the common man.

CPI-M leader Sitaram Yechury said he agreed 'in-principle' with the three issues raised by the team Anna but they will have to be implemented through constitutional procedures.

He said he wanted a new bill to be presented before Parliament which should be a "combination of best features of all the bills" including the Jan Lokpal Bill.

The Minister of State for Planning Ashwani Kumar voiced concerns in Rajya Sabha over demands like bringing the Prime Minister, conduct of MPs inside Parliament and lower bureaucracy under Lokpal's ambit.

Ashwani Kumar further said he was "distressed" by what was going on in Ramlila ground, where Anna Hazare is on fast for last 12 days demanding the passage of Jan Lokpal bill by Parliament.

Cautioning against provisions for appointment of Lokayuktas in states as suggested in Hazare's Jan Lokpal Bill, he said, "No attempts must be raised which could raise doubts about our intention, about the integrity of our federal structure."

He cautioned against rushing through the legislation "in haste or under pressure from people outside the House."

Uproar in Lok Sabha and the Rajya Sabha -on, Lokpal issue

Anna Hazare's fast on the issue of Lokpal cast its shadow on Parliament on Tuesday with both Lok Sabha and Rajya Sabha witnessing repeated adjournments over Lokpal Bill. The Lok Sabha and the Rajya Sabha were adjourned for the day without transacting any business after the two Houses witnessed two adjournments each.

It was trouble from the word go with BJP giving notices in both Houses for suspension of Question Hour to discuss the serious situation caused by lakhs of people in the country coming out on the streets to protest against corruption.

In the Lok Sabha, Leader of the Opposition Sushma Swaraj hit out at the government saying "it cannot wash its hands off the protests which are a result of the deep-rooted corruption in the government."

Swaraj dubbed the Lokpal Bill introduced by the government in the Lok Sabha as "poor, weak and ineffective".

The Lok Sabha also witnessed clashes between DMK and BJP members over issues to be taken up for discussion.

BJP members wanted an immediate discussion on corruption in the backdrop of Hazare's agitation, while the DMK pressed for a debate on Sri Lankan Tamils as listed in the agenda.

Both the Houses saw two adjournments - first soon after it met for the day and then at noon till 2 PM.

When the House met at 2 PM, the BJP and DMK members clashed again and Deputy Speaker Kariya Munda adjourned it for the day.

The story in the Rajya Sabha was no different. As soon as the House reassembled at 2 PM, BJP members rushed to the well and raised slogans, forcing the Chair to adjourn the House for the day.

BJP members led by Purshottam Rupala and Rudra Narayan Pany and AIADMK members raised slogans demanding a statement from Prime Minister Manmohan Singh on the Hazare issue.

In the Lok Sabha, as soon as the Speaker took up the first listed question, Opposition members were on their feet demanding suspension of Question Hour and discussion on corruption.

The Speaker said there was no rule that allows suspension of the Question Hour. However, as a special case she would allow leaders of parties to put forth their views on corruption and take up the Question Hour thereafter.

She then called Swaraj to speak. As Swaraj made references to several scams allegedly involving some Union ministers, Parliamentary Affairs Minister P K Bansal objected to it contending that the Leader of the Opposition was speaking on a matter which was beyond the ambit of the notice.

varungandhi80 Varun Gandhi What the people overwhelmingly support, the people's representatives have a duty to push for. varungandhi80 Varun Gandhi I urge and expect every opposition MP 2 give signed statements in support of the JanLokpal Bill as a way to pressure this govt to adopt it.

India.MPs are supposed to make laws that People want-"Prof R K Gupta"

The corrupt and emboldened congress government is trying different
tricks to weaken public movement.
They have pitted Aruna Roy against Anna team. This lady is stooge of
Sonia Gandhi and member of NAC an Extra constitutional civil body.In
other words Sonia is trying to dominate this movement and get her
version passed.Obviously Aruna Roy is frustrated person yearning for
her own publicity. This is the reason Indians are being enslaved since
last 1000 years.

The government Lokpal is so corrupt bill that instead of punishing
corrupt babus and politicians it targets even unaided NGOs to arm
twist and blackmail them and also punish whistleblowers instead of
protecting them.Punishment to babu is minimum 6 months and to
complainant is 2 years.
In other words these corrupt MPs have come up openly with a bill to
crush anti corruption movement and support corruption through lokpal
act.Such open and naked arrogance and sinister plotting can be
possible in India only.It is time to pack bags of sonia and her
associates and show black flag to congress party.

Already 1.7 crore people have sent sms supporting Anna jan Lokpal Bill
and 7 lac people have signed petition in support of Anna on
Avaaz.org.What more proof of public opinion in needed.Parliament and
MPs are advised not to try to act above people of India.MPs are
supposed to make laws that People want-

CBI conducts searches at premises of Jagan Reddy

A day after it registered an FIR against YSR Congress chief Y S Jagan Mohan Reddy in the illegal assets case, the CBI on Thursday conducted searches at the premises of various companies which have invested in the businesses of the Kadapa MP in five cities. The searches were carried out in Hyderabad and other places in Andhra Pradesh besides Bangalore, Chennai, Kolkata and Mumbai. The searches were being carried out at some of the offices of the firms owned by Jagan, besides at the residence of the Kadapa MP and that of his relatives in posh Banjara Hills area in Hyderabad. CBI searched the premises of AP Principal Secretary (Home) B P Acharya and also registered a case against Dubai-based Emaar properties and searched the premises of real estate developer Emaar-MGF in Hyderabad and Delhi. It is a case of conspiracy between AP government officials and Emaar in the development of villas and apartments, the agency said. The Andhra Pradesh High Court had on August 10 ordered a CBI inquiry into the land allotments made to Emaar by the then Rajasekhara Reddy Government and dilution of the stake of Andhra Pradesh Industrial Infrastructure Corporation (APIIC) in the joint venture with Emaar for the development of a township in the city.
Separate teams were formed to conduct the searches after the central agency approached the CBI Special Court to seek search warrants for over 90 locations owned by as many as 32 corporates and some individuals who have invested in the firms owned by Jagan.
Acting on the separate petitions filed by Textile Minister P Shankar Rao and TDP leader Yerran Naidu, the Andhra Pradesh High Court had recently ordered CBI to probe the alleged illegal assets that the Kadapa MP had amassed during his father's regime as Chief Minister. The agency in a separate case searched the premises of Principal Secretary (Home) Acharya and builder Emaar-MGF in Hyderabad and Delhi. The case relates to alleged criminal conspiracy between state government official and Dubai-based Emmar group for diluting state government's Andhra Pradesh Industrial Corporation's stake in a posh township developed through a joint venture, the agency spokesperson said.Reacting to the development, Executive President Emmar-MGF Sanjiv Saddy said, "As a corporate policy, the group always cooperates with the investigating agency and adheres by the law. We are providing all the documents sought by the CBI officials and cooperating with them."The Andhra Pradesh High Court had on 10th August ordered a CBI inquiry into the land allotments made to Emaar by the then Rajasekhara Reddy Government and dilution of the stake of Andhra Pradesh Industrial Infrastructure Corporation (APIIC) in the joint venture with Emaar for the development of a township in the city.
CBI, which constituted 15 teams for the operation, searched some of the offices of the firms owned by Jagan, besides his residence and that of his relatives in posh Banjara and Jubilee Hills area in Hyderabad.Searches were on at the residences of Vijay Sai Reddy, who is vice-president of Jagati Publications (which publishes Sakshi Telugu newspaper and also Sakshi TV), owned by Jagan, and his sister Sharmilas residence at Sagar Society in Hyderabad. The CBI teams also conducted searches at the residences and office premises of individual investors including Nimmagadda Prasad of Matrix Labs and Lagadapati Sridhar who runs Jubilee Media in Hyderabad. Sridhar is youngest brother of Vijayawada MP Lagadapati Rajagopal.

Among the firms where CBI conducted searches include R R Global, Sandur Power, Jagati Publications, Carmel Asia Holdings and Bharati Cement.
CBI Joint Director V V Lakshmi Narayana, who is heading investigations, said they would brief the media on the developments after completion of the searches.
A senior CBI officer said, "Searches were conducted at the residence of Acharya and we have collected some documents".
Acharya was the then managing director of Andhra Pradesh Industrial Infrastructure Corporation (APIIC).
The controversy centres around dilution of APIIC's equity from 49 percent as agreed in the original memorandum of understanding (MoU) to 26 percent and also Emaar roping in its group company Emaar-MGF Land Limited as a co-developer for the township component of the 258-acre integrated township project at Gachchibowli in Hyderabad.

Delhi police issues release warrant of Anna after Parliament disrupted over his arrest.Arrested social activist is set to be released any time from now as Delhi police spokesperson Rajan Bhagat a short while back said that they have issued the release warrant of Anna Hazare who was arrested for defying prohibitory orders and sent to seven days judicial custody.Parliament was paralysed on Tuesday over the detention of Anna Hazare and his supporters, with the Opposition accusing the government of "murdering" democracy and likening the situation to Emergency.BJP, CPI and JD(U) and some others wanted suspension of Question Hour in both Lok Sabha and Rajya Sabha to discuss the issue in the backdrop of corruption and created pandemonium when the plea was rejected.Because of the uproar, which began as soon as the two Houses met for the day, no business was transacted in either House.Rajya Sabha was first adjourned till noon and then for the day.
The Lok Sabha was adjourned till 11.30 AM, then till noon and finally for the day.

Arun Jaitley: Govt crushing voice of dissent outside the House.
In the Rajya Sabha, Leader of the Opposition Arun Jaitley alleged that government was indulging in "murder of democracy" while senior BJP leader Yashwant Sinha said in the Lok Sabha that "there is Emergency outside Parliament, there is Emergency inside Parliament."
When the Lok Sabha met for the day, Speaker Meira Kumar informed the House that suspension of Question Hour notices had been given by Leader of the Opposition Sushma Swaraj, CPI leader Gurudas Dasgupta and JD(U) member Sharad Yadav among others. They wanted an immediate debate on the detention of Hazare and on the larger issue of corruption. The Speaker disallowed the notices for adjournment motion given by Yogi Adityanath (BJP) and Shailendra Kumar (SP) on Hazare and some issues related to Uttar Pradesh.

She said there was no provision for suspension of Question Hour in Lok Sabha, but asked the members making this demand to "briefly touch upon the subject".
However, when Swaraj rose to speak, Parliamentary Affairs Minister P K Bansal intervened and said, "My submission is that the government is prepared for a discussion at 12 (noon). They make their point and then the House is disrupted..."
He insisted that if Swaraj is allowed to speak, the Home Minister should also be allowed to make a statement.Agitated members of BJP, JD(U), CPI-M, CPI, SP and BSP were on their feet objecting to Bansal's comments.
Congress members too were on the feet and demanded that the Question Hour be held.
Sanjay Nirupam (Cong) said his party was objecting to opposition parties supporting those going against democracy. The Speaker then adjourned the House till 11:30 am.When the House re-assembled, similar scenes were witnessed and the Chair adjourned it till noon. There was uproar again at noon, with BJP members chanting that the government was "murderer of democracy" and insisted that Swaraj be allowed to speak.Sinha said there was "undeclared emergency" and declared the House will not be allowed to function till Swaraj spoke.Swaraj was unhappy for being disallowed to speak even though Bansal had promised that she could do so at noon.

The Speaker, while disallowing it, said it was a matter related to the Question Hour. The BJP members rushed to the well creating pandemonium, prompting the Chair to adjourn the House for the day.Swaraj alleged that Bansal was defying the Speaker by not allowing her to speak.
"The undemocratic attitude adopted by the government outside the House is being adopted inside as well," she said.In the din, a short duration discussion on Sri Lanka could not take place even as the Speaker called DMK leader T R Baalu to initiate it.In the Rajya Sabha, when Chairman Hamid Ansari took up the first question, Jaitley rose to make a statement.Ruling Congress members prevented Jaitley from speaking.

"Let us hear the Leader of the Opposition," Ansari said as Congress members stood up demanding that the Question Hour be taken up first. At this, opposition members shouted back at the ruling benches, plunging the House into turmoil.Minister of State for Parliamentary Affairs Rajeev Shukla said the Home Minister will make a statement at noon. But this failed to pacify the opposition members and the din grew louder with ruling party members raising their pitch against Jaitley being allowed to speak."This is not right. Please allow the Leader of the Opposition to speak," Ansari said asking members to resume their seats. Kapil Sibal shown black flags in a meeting in Delhi, bouncers took Care.
